when you typed that your husbands check didn't clear and that your husbands Bosses check did. Now that I understand what you had said, you now have to go back to the person who gave you the check in the first place and get the fee's from them, since it was THEIR check that caused the fees. You are right...

What they did is not legal, and you would be well within your rights to prusue them for the rest of your fees, although probably not worth the aggravation.
What they did was try to cover their losses out of your pocket. I suspect it was done at a branch level by someone who thought they could get away with it.
