Closed cases have been settled in court but no one has ever been paid by this guy , his insurance , or his company. Why contract with someone like this?

Sued by customers, suppliers, attorneys, and others.

I contracted to have a new driveway, garage floor, sidewalks, stamped patio and a shed slab poured in concrete with Tony's Concrete Services, LLC, Of Franklin, WI, new location now Muskego, WI in the amount of . $11,197.00. The contractor, Tony's Concrete Services LLC, Tony Tomasino and his wife Mary Beth, and their crew where hired to do the work which included removing the old concrete and pouring the new. They were also charged with pulling the required permits, whatever they would need, setting all forms, etc.. Basically, they were to do the entire job from start to finish all inclusive according to the codes and according to the verbal information and according to the proposal I received. The workmanship on parts of the job was poor, the problems were not corrected, other problems were created by the work that was done, the company continues to put a spin on what they want to do to correct the problems which it nothing. They have made promises to do additional work, fix or correct bad work, and resolve problems. They have given me dates to have the work done and nothing to date has been corrected, fixed, repaired. I received an email that said they have tried to contact me several times with no response via email. There were two emails both were responded to by myself. In the last of those two emails they said there would be a follow up email to explain what would be done to fix and correct the problems. That was months ago. Email says I have not given them an opportunity to do what is needed. On November 29, 2012, I received an email from T C S, LLC stating that " also come spring, I am hauling in your five yards of dirt free of charge. Going to fix the small crack by the downspout, INCLUDING spring 2013, I will also throw in sealing your driveway and walkway" It was an ordeal to get the dirt delivered and nothing else was done by spring or to date. Besides the above none of the other problems which have been emailed in great detail over and over again have been worked on, repaired, or corrected. Their claim, I have not given them time to do the work. They made no attempt to contact me to do the work until 4 days before they knew I was going out of town and then wanted a week that I would be there so they could the work. My wife or myself was there spring and summer of 2013 and nothing was ever done. No contact was made to make a date to do the work. I was told they "could not pull the crew off a paying job to do repairs". I was promised by Tony Tomasino that "the work would be right, I don't take short cuts, you will be happy, it will be done right." It was not done right, short cuts were taken, I am not happy. My home will continue to receive water damage and have on going repairs because of the work done by Tony's Concrete Services, LLC. I have dozens of emails and have given then all spring and summer of 2013 to do the work and nothing has been done other then the delivery of 5 yards of top soil. #1 The down spout area which is sidewalk was promised to be redone as it was damaged when the crew was saw cutting the concrete. I was told that would be taken care of in spring of 2013. Nothing has been done. Tony said he would put the down spot under ground and pour the concrete sidewalk over it so I would not have to step over the down spout all the time. No Permit was pulled which is required in Franklin, WI. The work was not inspected and the work as it was done does not meet code and is not done with the materials the code calls for. I received an email from TCS, LLC after I discovered there was a code for this and was told that "What the city does not know about, they don't know about." #2 They poured a shed slab. It is in the proposal to do the work and part of the bid and they now claim they did that work for free. The problem with the work done is that it was not done to code and no permit was pulled so again there was no inspection of the work. Permits are needed for a shed slab in Franklin, WI. The contractor pulled one out of the tree permits needed. That was the one where everyone saw the work being done. City unwilling to issue a shed permit as the slab was not done to code. Now they say it is my responciplity to make sure permits were pulled. There was no question the contractor was to pull all permits not just one permit. #3 In January 2012 I returned to my home where my daughter was house sitting for me to find that the garage floor was pitched to the inside of the garage. Any water on the garage floor in the northeast quarter of the garage runs into the house instead of out the overhead garage door. The water piles up inside the garage along the inner wall. Mary Beth Tomasino of TCS, LLC came to inspect several problems and discuss the lack of snow removal on a separate contract. After looking at the floor and the water stains on the floor she concluded that the refrigerator in the garage was leaking and something was running out from under the refrigerator into the center of my garage. I offered to open a bottle of water and pour it on the floor so she could see she was wrong and I was told " Tony would have to come out and look at this but I needed to get the refrigerator looked at." There is also a large crack running through that area of the garage floor and I was told "Only Tony can look at that to see what needs to be done". Tony has never paid me a visit. #4 When the drive was poured the height was raised over three inches on the north side of the garage door creating a water problem with the siding at that location. #5 The Drive approach looks as bad as the old one did as it is popping and cracking. The old approach was 30 plus years old and this is in that same condition. Earlier in the year there were 120 plus stone pops in the approach alone and another 10 to 20 small cracks. That is about 7 stone pops per square foot. Now there are more. appointments were made to have it inspected, wife was home, no show. Of course later in the week it was said to be inspected when no one was home. I was told by Mary Beth Tomasino I would get a copy of that inspection and the findings in the mail. No copy ever arrived. I was told I would get an email copy of the report. No Email copy. I asked for a copy in 3 or 4 other emails and never received that report or any information from the inspector, whoever that was. Currently there is a new large crack forming because a saw cut was made improperly and there was no cut put in as a stop gap. That saw cut is now cracking the approach in half as the gap get larger and larger. Regarding the driveway, In a separate snow removal contract with Tony's Concrete Services, LLC for the winter of 2012/2013 to remove snow from the drive, sidewalks, and patio, Tony and Mary Beth stressed snow removal, no use of salt, using plastic shovels to remove snow, no snow blowers and other information in the contract which stated that snow and sleet under two inches would be removed from the drive and walk and patio to keep the snow from damaging the new concrete. When returning to my home in January of 2013 I arrived to find my drive covered with ice and snow that had been there for days. Upon talking with neighbors I was told that a snow plow truck had been used in the drive on at least one occasion. Plastic shovels? I called about damage to the driveway and received no less than 6 scenarios of how that may have happened. Every time I would show why that one scenario would and could not be the reason for the damage, a new reason was offered up as to what now caused the damage. At the time Mary Beth Tomasino was out to the house to put sand on the drive, the drive, the sidewalks and the patio were all ice and snow covered. While I was complaining to her that she was not doing the work as per the contract, I was told that " None of our other customers are complaining" I don't know what was in the contracts of the others clients, mine called for this ice and snow to be removed. #6Mary Beth Tomasino also inspected the stamped patio which also has stone pops and said Tony would have to look at it. Never Happened! #7 The threshold for the side garage door was removed during the removal of the old garage floor. It was temporarily supported with shims. The shims are still in place and nothing but the shims hold the threshold in place. Water, Snow, small rodents, etc can come and go through the open threshold. There are other more minor problems, these are the major problems which have not been corrected in any way.

She claims that she has hired this company to do work and it was done very well. She is part of the company, married to Tony!!
