As I noted in a previous reply, sexual misconduct is prohibited. In code, there is no clause (that I have been made aware of) that "permits" or "excuses" sexual misconduct based on the theory of "consensuality". The reason that it is not defensible or excusable is the patient is considered "vulnerable" without taking any of his/her medical conditions (including mental status) or medications...
